Terms and Conditions

1. The terms set out in the booking form are the total agreement made between the parties and no variation or modification of this contract shall be effective unless agreed by both parties in writing.
2. The client understands and accepts that the film coverage will be as the director’s professional expertise determines. Special requests are not binding, although every effort will be made to comply with clients’ wishes.
3. Any images or copies of images are protected by the copyright and Design Act 1988. It is contrary to the act to copy or allow to be copied photographically / electronically or by any other means an image created as part of this contract without permission of MacDonald Studio in writing. Any breaking of seals will presume a breach of copyright.
4. Negatives / digital files / master tapes remain the property of MacDonald Studio. The clients are able to purchase all master tapes for an agreed price. If the client declines to buy the master tapes within two months of the wedding, the company reserves the right to destroy or re-cycle all master tapes.
5. The film maker/s shall be granted complete artistic licence, including in relation to the poses filmed and the locations used. Due to the vagaries of the weather and the willingness of subjects in may not be always possible to capture all the images requested.
6. Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. In this event the liability of the company is limited to making a refund of all monies paid under the agreement.
7. Cancellation fees - within two months of filming date: 50% of package price
Cancellation fees - within 1 month of filming date: 100% of package price
8. In the event of any camera person being unable to perform or complete the agreement for any reason, including technical failure, ill health, accident or vehicle breakdown, the Company will use their best endeavours to secure a replacement director. However, if no such replacement can be secured, then the liability of the company is limited to making a refund of all monies paid under the agreement.
9. Whilst every effort is made to ensure that all equipment is in sound working order, MacDonald Studio's liability in the event of the director or editor being unable to perform or complete the engagement due to malfunction of equipment shall be limited to making a refund of all monies paid under the agreement.
10. Whilst every effort is made to ensure the best sound quality using our equipment, we cannot control the acoustics of the venue, the projection of voices and the PA system of the venue. All of these fators are outwith the control of MacDonald Studio so in the event of the client's dissatisfaction with the sound quality, MacDonald Studio's liability shall be limited to a partial refund proportional to the section of footage that is in dispute.
11. The balance of the package ordered must be paid in full at least 14 days before the date of the wedding, or MacDonald Studio reserves the right to cancel the booking / agreement.
12. Any complaints should be raised by the Client with the company in writing within 28 days of first becoming aware of the matter to be complained of, in any event, within 28 days of receipt of the DVD..
13. Clients can upgrade their package at any point but cannot downgrade their package within one month of the date of the wedding.
14. If the distance between the venue of the pre-ceremony filming with the bride and the venue for the ceremony is more than 20 miles a £25 surcharge will be incurred.
15. All travel up to 55 miles from our base in Mount Vernon, Glasgow is included in the package price. Locations situated beyond that distance could be subject to extra fees and overnight expenses to be agreed by both parties. All extra filming required after 11pm, or extra filming required over ten hours, will be subject to overnight accommodation charges and expenses.
16. A fee of £25 is levied for all City Centre filming locations to cover car parking fees, and cab fares where access to location is prohibitive etc.
17. The booking fee of £50 is non-refundable.
